For people age 21 or older, .08 percent is above the legal limit of blood alcohol content.  For people under the age of 21, any amount of alcohol in the system is illegal, and if found to be operating a vehicle while under the influence of alcohol, they will be charged with Tennessee Underage DWI or Tennessee DUI.  There is a zero tolerance law in Tennessee, meaning that any driver under 21 years old with a BAC of greater than .02 percent can be charged with a Tennessee DUI and will have their driver’s license suspended.  

 

There are certain procedures, which must be followed by an officer in order for a Tennessee DUI conviction to be possible.  The underage driver has to be stopped for some other traffic violation, DUI checkpoint, or traffic accident, and cannot be pulled over simply under “suspicion” of drunk driving.  After the officer speaks with the underage driver, if Tennessee DUI or underage Tennessee DWI is suspected, they may then administer a field sobriety test to determine if the motor skills are impaired, which may point to intoxication.  If the underage driver performs poorly during the field sobriety test, the officer will then have probable cause to arrest for DUI and determine if the zero tolerance law has in fact been violated.
